1. Acceptance of “Terms and Conditions”
Www.mihipita.lk is an online marketplace which provides a variety of classified advertising services (referred to hereafter as "Our Services”) in Sri Lanka. “Anyone who uses Our Services directly or indirectly” (referred to hereafter as "Users”) must by all means agree to comply with Wwww.mihipita.lk’s Terms and Conditions. In addition, when using Our Services, Users must agree to abide by any applicable guidelines or articles published on our Help & Support page to get a proper understanding of Our Services and how to buy and sell safely using the Content published on www.mihipita.lk.

Users must accept that www.mihipita.lk, its owners or its staff (referred to hereafter as any of "We”, “Us” or “Our”) by no means have any liability or responsibility for any kind of loss or damage caused to its Users or any third parties directly or indirectly by using Our Services and it will be solely the Users responsibility to act safely on all kinds of transactions they make using the Content available on www.mihipita.lk. Should the Users object to any of these “Terms and Conditions”, guidelines or any subsequent modifications of their Content or become dissatisfied with Our Services at any point, Users must immediately discontinue using www.mihipita.lk and Our Services.

2. Modifications to “Terms and Conditions”
Www.mihipita.lk reserves the right, at Our sole discretion, to change, modify or otherwise alter these Terms and Conditions at any time. Such modifications shall become effective immediately upon the posting thereof. Users must review this agreement on a regular basis to keep themselves apprised of any such changes. We may keep the “last date of update” published at the bottom of this page whenever a modification is done on our Terms and Conditions.

3. Content
Users understand that all postings, messages, text, files, images, photos, videos, sounds, or other materials (referred to hereafter as "Content") posted on, transmitted through, or linked from the Content, are the sole responsibility of the person from whom such Content is originated. More specifically, Users are entirely responsible for all the Content that they post, or make available via www.mihipita.lk. Users guarantee that the Content they post on www.mihipita.lk, do not violate any copyright, intellectual property rights or other rights of any person or entity, complies with all applicable laws and agrees to release www.mihipita.lk, its staff from all obligations, liabilities and claims arising in connection with the use of (or the inability to use) “Our Services” and the Content available on www.mihipita.lk. Users understand that although We make Our best efforts regularly to review the Content on www.mihipita.lk made available by its Users, We cannot authenticate the accuracy or the legitimacy of the Content or the Users who posted them and We are not responsible for any Content that could be fraudulent, offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, www.mihipita.lk and Content available through Our Services may contain links to other websites, which are completely independent of Our Services. www.mihipita.lk makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained on any such site. Users linking to any other websites are themselves fully responsible of their act and consequences.
Users agree that they evaluate, and bear all risks associated with, the use of any Content, that they may not rely on said Content, and that under no circumstances will www.mihipita.lk or its staff be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content available on www.mihipita.lk. Users agree that their Content may be presented through www.mihipita.lk's partner sites under the same “Terms and Conditions” as on www.mihipita.lk. Users acknowledge that www.mihipita.lk shall have the right in its sole discretion to refuse, delete, edit or move any Content that is available via www.mihipita.lk, for violating the Terms and Conditions or for any other reason.

4. Notifications of Claims and Infringement
If Users believe that any of their property or service has been unlawfully posted on www.mihipita.lk, their work has been copied in a way that constitutes copyright infringement or their property or intellectual property rights have been otherwise violated, please notify Us by emailing to [email protected]

Please include below information in your email:
  1. a) Advert ID: Of the advert on mihipita.lk that you claim is infringing your property.
  2. b) Advert details: Please include details about the advert with Topic and description posted.
  3. c) A statement by you declaring your claim is accurate and proof that you are the owner of the property or that you are authorized to act on behalf of the owner;
  4. d) Your address, telephone number, and email address
  5. e) Your physical or electronic signature.
Www.mihipita.lk will suspend the infringing posting(s) or Content, verify with the advertiser and delete or reactivate upon the information we collected.

5. Copyright
Users grant www.mihipita.lk a perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such Content or incorporate such Content into any form, medium, or technology now known or later developed. Users agree that they should not: copy the Content on www.mihipita.lk, reproduce, republish, install, post, transmit, store or distribute without written permission from www.mihipita.lk.

6. Privacy and Information Disclosure
Users agree that www.mihipita.lk  use the email addresses provided by registered Users at the registration which is mandatory in providing Our services by emailing the Users about their registration or advertisement status. Users’ email address will not be disclosed unless Users separately post their email address in the description of their Ad. Users also may optionally post their phone number which will be published along with the Ad as a mean for the buyers to contact the Sellers. While www.mihipita.lk take all reasonable efforts to safeguard the confidentiality of User’s said non disclosed information, www.mihipita.lk will have no liability for disclosure of any information obtained due to errors in transmission or the unauthorized acts of third parties. Users further acknowledge and agree that www.mihipita.lk may, in its sole discretion, preserve or disclose their Content, as well as their information, such as email addresses, contact numbers and any other available user information: if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to comply with legal process; to enforce these Terms and Conditions; to respond to claims that any Content violates the rights of third-parties; to respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment; to protect the rights, property, or personal safety of www.mihipita.lk, Users or general public.

Furthermore Users consent and authorize www.mihipita.lk to collect and use above said information and reserve the right to disclose it to company affiliates and any other person for the purposes of administering, supporting and maintaining, researching, marketing and product development of www.mihipita.lk.

7. Limitations on Our Services
Users acknowledge that www.mihipita.lk may establish limits concerning the use of Our Services, including the maximum number of days that Content will be retained by Us, the maximum number of images, Videos and the size of descriptions. Users agree that www.mihipita.lk has no responsibility or liability for the deletion or failure to store any Content maintained or published by Our Services. Users acknowledge that www.mihipita.lk reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that www.mihipita.lk shall not be liable to Users or to any third party for any modification, suspension or discontinuation of the Our Services.

8. Site availability
Users acknowledge that www.mihipita.lk cannot guarantee a continuous, error-free or secure access to Our Services or that any defects of it will be corrected at earliest possible with no estimated time. While We will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee and do not give any promises or warranties about the operation and availability of our sites, services, applications or tools and Users agree that www.mihipita.lk web site is provided "as is" and when available.

9. Use of Cookies
Users acknowledge that www.mihipita.lk uses cookies to hold session information, registration information, ensure effective advertising tailored to their needs and save an individual User’s password, once entered, so that it does not have to be re-keyed during the session. Users may refuse to accept cookies by activating the setting on their browser which allows Users to refuse the setting of cookies. However, if Users select this setting they may be unable to access certain parts of Our Services. Unless Users have adjusted their browser settings so that it will refuse cookies, www.mihipita.lk will issue cookies when Users log on to www.mihipita.lk.

10. Termination of Service
Users agree that www.mihipita.lk, in its sole discretion, has the right to delete or deactivate their account, block their email or IP address, or otherwise terminate Users access to or the use of Our Services (or any part thereof), immediately and without notice, and remove and discard any Content on www.mihipita.lk, for any reason, including, without limitation, if www.mihipita.lk believes that Users have acted inconsistently with Our Terms and Conditions. Further, Users agree that www.mihipita.lk shall not be liable to Users or any third-party for any termination of their access to the Service. Further, Users agree not to attempt to use Our Services after said termination.

11. Disclaimer
Www.mihipita.lk or its staff have no responsibility what so ever for the use of www.mihipita.lk and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on www.mihipita.lk or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or Content directly or indirectly accessed through links in www.mihipita.lk, (c) the unavailability of www.mihipita.lk, (d) use of www.mihipita.lk or the Content, or (e) use of any equipment (or software) in connection with www.mihipita.lk

12. Indemnification
Advertisers and Users agree to indemnify www.mihipita.lk as well is its Owners or staff from and against all losses, expenses, damages and costs, including attorney's fees, resulting from any violation of this  “Terms and Conditions” (including negligent or wrongful conduct).

13. Posting rules and Conduct
Users agree not to post any information including images, videos, descriptions or otherwise make available Content:
  1. a) If Users are under 18 years of age.
  2. b) That advertises any illegal service or the sale of any items which is prohibited or restricted by any applicable law in Sri Lanka including drugs, alcohol, firearms and ammunitions.
  3. c) That is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way.
  4. d) That is pornographic or depicts a human being engaged in any kind of sexual conduct.
  5. e) That harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or any other applicable nature;
  6. f) That includes personal or identifying information about another person without that person's explicit consent;
  7. g) That is false, deceptive, misleading, deceitful or constitutes "bait and switch";
  8. h) That infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or Content that the Users do not have a right to make available under any law or under contractual or fiduciary relationships;
  9. i) That constitutes or contains "affiliate marketing," "link referral code," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
  10. j) That constitutes or contains any form of advertising or solicitation if: posted in areas of the www.mihipita.lk sites which are not designated for such purposes; or emailed to www.mihipita.lk Users who have not indicated in writing that it is ok to contact them about other services, products or commercial interests.
  11. k) That contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  12. l) That employs misleading email addresses, contact numbers, or forged headers or otherwise manipulated identifiers in order to disguise the origin of Content transmitted through the Service.

13.1 Additionally, Users agree not to:
  1. m) Contact any buyer or seller www.mihipita.lk who has asked not to be contacted;
  2. n) Collect personal data about other Users for commercial or unlawful purposes;
  3. o) Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service - unless expressly permitted by www.mihipita.lk;
  4. p) Post non-local or otherwise irrelevant Content, spam, repeatedly post the same or similar Content or otherwise impose an unreasonable or disproportionately large load on our infrastructure;
  5. q) Post the same item or service in more than one classified category or forum, or in more than one location;
  6. r) Attempt to gain unauthorized access to www.mihipita.lk's server platforms or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service or the www.mihipita.lk website; or
  7. s) Use any form of automated device or computer program that enables the submission of postings on www.mihipita.lk without each posting being manually entered by the author thereof (an "automated posting device"), including without limitation, the use of any such automated posting device to submit postings in bulk, or for automatic submission of postings at regular intervals.
